What is Mental Health Leave?
Mental health leave is commonly treated as a form of sick leave or personal leave where an employee is unable to work because of a mental health-related illness, injury or condition.
There is no separate universal entitlement called “mental health leave” under the National Employment Standards. However, eligible employees may be able to use paid sick and carer's leave where a mental health concern affects their ability to work.

If you need time away from work because of a mental health-related illness or injury, your employer may ask you to provide evidence that would satisfy a reasonable person that you were not fit for work.
